ALL SPORTS RELEASE, WAIVER & INDEMNITY AGREEMENT

In exchange for the opportunity to participate in Harrison Women’s Recreational Sports League (also referred to as The Sports Gals), and including the Women’s Soccer League, the Women’s Basketball League, the Women’s Volleyball League, the Women’s Softball League, the Husband/Wife and Co-Ed Games, and any other sports leagues, events, activities and/or any other events related to and/or arising out of such activities, whatsoever (herein collectively referred to as the “League”), each of the undersigned persons “the League Participants” execute this release, waiver & indemnity agreement (the “Agreement”) as of the date set forth beside their respective signatures below, and each of the League Participants below do hereby agree to the foregoing paragraph, agree to the sufficiency of consideration for execution of this Agreement and further agree as follows:

 1.           Voluntary Joinder & Sportsperson-like Conduct.  I voluntarily join or participate in the League for the purpose of playing recreational sports and engaging in any and all related activities (including, without limitation, soccer, basketball, volleyball, softball and/or any other sport and social activities relating to same) and I agree to conduct myself courteously and in a sportswoman-like or sportsman-like manner throughout all aspects of participation in the League.  I understand that if I engage in unsportsperson-like conduct or improper or dangerous behavior, I may be asked to permanently or temporarily excuse myself from further participation in the League and I agree to honor such request without opposition or other event;

2.           Covid-19 and Other Health Protocol Compliance and Assumption of Risk. I agree that I have assumed any and all health and/or other risks associated with participating in the League and that I will not hold or attempt to hold any person or entity other than myself responsible for such risks at any time, by any means and/or for any reason.  I am aware of the risks presented by my participation in the League for contracting potential illness, including without limitation the risks associated with contracting the Covid-19 virus and any and all of its variants (collectively “Potential Illness”).  I agree to abide fully with any and all protocols established by the Town of Harrison, if any, for the League regarding any Potential Illness and I understand that I may be temporarily and/or permanently excluded from participation in the League for violation of any such protocols.  I agree to refrain from participating in the League any time I experience signs of illness and/or when I have tested positive for any transmissible disease.  If I test positive for a transmissible disease after participation in a League event I will immediately notify the coordinator(s) via email or telephone so that other participants exposed to such transmissible disease can be identified and notified and/or so that further meetings can be cancelled as necessary.  Regardless of protocol compliance by myself or any other person, I hereby assume any and all risk of Potential Illness, including Covid-19 and any variants, and/or any health and/or other risks associated with participating in the League. I agree I will not hold or attempt to hold any person or entity other than myself responsible for such risks at any time, by any means and/or for any reason;

 3.           Permission for Dissemination of Information.  I give my permission for my name, likeness, street address, email address, telephone numbers and other contact information to be distributed to other persons and/or entities for any and all League-related and/or Team-related purpose(s), including without limitation, distribution to other League Participants in order to facilitate communication among League Participants and/or to others for other purposes beneficial to the League.  In addition, I promise not to use the League Participant contact information for any improper purpose, including for any commercial purpose.  I also agree that should I test positive for transmissible disease the League has my express permission to notify other individuals and the Town of Harrison as necessary to promote the safety of the League and/or to enforce the Town of Harrison’s safety protocols;

 4.           Release.  I hereby release, acquit and forever discharge any and all persons and entities, whatsoever, including without limitation, the following persons and entities (collectively referred to as “Releasees”), from any and all liability, damages, injuries, losses, attorneys’ fees  and/or expert fees, costs, legal relief, equitable relief, and/or any and all other amounts arising from and/or relating to, in any manner whatsoever, my participation in the League and its activities, including without limitation, arising from and/or relating to participating in any sport(s) and/or any activities relating to the League and distribution of the participant contact information as described in this Agreement and including without limitation any exposure to Potential Illness (including without limitation Covid-19 and any of its variants) during my participation in the League:  

“Releasees” is defined as:  any and all persons and entities whatsoever, including without limitation, the following persons and entities:

a.  The Town and Village of Harrison and all of its affiliates ,including without limitation, the entire Town of and Village of Harrison and its subdivisions and affiliates, including without limitation, Purchase, West Harrison, the Town of Harrison, the Village of Harrison, the Harrison Central School District, the Town of Harrison’s agents, employees, supervisors, town supervisors, mayors, superintendents and assistant superintendents of recreation, insurers, attorneys, representatives, volunteers, boards, council members, and any and all persons acting in behalf of the Town or Village of Harrison or any of its affiliates;

b.   Any and all former, present and future Team Captains, coaches, organizers and/or coordinators of the League and/or its events, including without limitation, Deborah Ryan, Karen McAlister, Ina Thonfeld, Rie Tabata, Marilda Smyth, Caroline Feeley, Meg Omonishi, Carolyn Laskaj, and Mary Payton Emery (all of whom I agree:  serve as a volunteers only; and are not responsible to me in any manner; and, are not employees or agents of the Town of Harrison);

c.    Skynet Limousine Service, Landmark Transportation, LLC. and any and all other sponsors of the League ; and

d.   All League Team(s) and each and every one of the former, present and future League Participants, opponent players, adversary players, opponent coaches, any and all former, present or future landowners, referees, officiators, and/or any other person(s), whatsoever;

e.   All “Government Entities and Agencies,” including without limitation all cities, towns, villages and other government entities and agencies and each of such entity’s agents, employees, supervisors, mayors, superintendents and assistant superintendents of recreation, insurers, attorneys, representatives, volunteers, boards, councilmembers and any and all persons acting in behalf of such entities or their affiliates; and

f.   The Southern Westchester Women’s Soccer League and the Westchester Women’s Soccer League;

 5.   Agreement Not To Institute Actions & Agreement to Indemnify.  I agree not to institute any action and/or proceeding against any and/or all of the Releasees in violation of this Agreement.  To the full extent I or anyone in my behalf breach any term(s) of this Agreement, I agree to completely indemnify, hold harmless and defend any and all of the Releasees as against whom I have breached this Agreement for any and all liability, damages, injuries, losses, attorneys’ fees and/or expert fees, costs, legal relief, equitable relief, and/or any and all other amounts arising from and/or relating to, in any manner, whatsoever, such breach of this agreement.

READ THE ABOVE AGREEMENT CAREFULLY: YOU ARE NOT AUTHORIZED TO PARTICIPATE IN THE LEAGUE UNLESS YOU READ THE ABOVE AGREEMENT AND SIGN BELOW TO INDICATE YOUR AGREEMENT.  EACH PERSON WHO SIGNS BELOW IS A “LEAGUE PARTICIPANT” AND HEREBY ASSUMES ALL RISK, INCLUDING RISK OF ANY  POTENTIAL ILLNESS, AND VOLUNTARILY WAIVES AND RELEASES ALL RIGHTS AND AGREES TO THE TERMS AND CONDITIONS OF THE ABOVE AGREEMENT IN EXCHANGE FOR THE OPPORTUNITY TO PARTICIPATE IN THE LEAGUE AND/OR ITS ACTIVITIES AND FOR OTHER GOOD AND VALUABLE CONSIDERATION:
